We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

6. INTERNATIONAL TRANSFERS

We may share your personal data within the B&H group of companies, which may involve transferring your data outside the European Economic Area (EEA).

Also, some of our External Third Parties are based outside the EEA, so their processing of your personal data will involve a transfer of data outside the EEA.

Whenever we transfer your personal data out of the EEA, we strive to ensure that a similar degree of protection is afforded to such data by ensuring that at least one of the following safeguards is implemented:

  • transferring your personal data to a country, organisation or sector that has, at the time of transfer, been deemed to provide an adequate level of protection for personal data by the European Commission;
  • using specific forms of contract approved by the European Commission that give personal data the same protection it has within Europe; and/or
  • transferring data to a provider based in the US if such provider is part of the Privacy Shield, which requires it to provide similar protection to personal data shared between the Europe and the US.

7. DATA SECURITY

Our servers are securely located in the United Kingdom and are maintained by a limited number of users.

More generally, we have put in place appropriate security measures (including user authentication software and secure data-sharing feeds) to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach, and we shall notify you and any applicable regulator of a breach where we are legally required to do so.

Security of payment processing

The Shop at Boosey.com
No bank details entered on the Site are stored on our network servers. All card payments are processed through two layers of third-party payment processor security, 3D-secure cardholder identification (Verified by Visa) and the Monek (UPG) payment gateway service, both of which are PCI-compliant. We also have SSL certificates in place within our secure check-out, providing high-level internet security. Encryption is 256-bit using SHA256 with a 2048-bit RSA key. These are provided by GoDaddy.

The Boosey & Hawkes UK Hire Library
No bank details entered on the Site are stored on our network servers. All card payments are processed through third-party payment processor security using the Stripe payment system with data servers based in the US. If you are located in the EEA or Switzerland, Stripe complies with applicable laws to provide an adequate level of data protection for the transfer of personal data. Stripe is certified under the EU-US and the Swiss-US Privacy Shield Framework.

8. DATA RETENTION

We will only retain your personal data for as long as necessary to fulfil the purposes for which we collected such data, including for the purposes of satisfying any legal, accounting or reporting requirements.

By law we have to keep basic information about our customers (including Contact, Identity and Transaction Data) for six years after they cease being customers for tax purposes.

Customers’ invoices are stored for a minimum of six years after the end of the current tax year in which the invoice was raised.

In some circumstances you can ask us to delete your personal data: please see Request erasure below for further information.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). We may, however, charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in those circumstances.

What we may need from you
We may need to request specific information from you to help us confirm your identity and to ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data are not disclosed to any person that has no right to receive such data. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we shall notify you and keep you updated.

LAWFUL BASIS

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product/content and the best and most secure experience. We make sure that we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to do so by law). Performance of a Contract means:

Internal Third Parties means:
other companies in the B&H group of companies (acting as processors), which are based in the EU and provide certain administration services to us.

External Third Parties means:

  • Service providers (acting as processors) based in the UK, EU and USA who help us to fulfil our contractual obligations and to operate our business, including those providing us with certain marketing and data-processing services (such as Dotmailer (UK and USA) and Zinfonia (USA), order fulfilment services (such as Music Exchange (Manchester) Limited, based in the UK), payment processors (such as GoDaddy (UK), Monek and Visa 3D-Secure and Stripe (USA) and IT and communication services (such as server-hosting, CRM-platform, email and telephony providers).
  • Professional advisers (acting as processors or joint controllers), including lawyers, bankers, accountants and insurers, who are based in the UK and provide their respective professional services to us.
  • HM Revenue & Customs, regulators and other authorities (acting as processors or joint controllers), which are based in the UK and may require reporting of processing activities in certain circumstances.

YOUR LEGAL RIGHTS

In certain circumstances, you have the following legal rights in relation to your personal data:

Right of access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data that we hold about you and to check that we are lawfully processing such data.

Right of rectification of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, although we may need to verify the accuracy of the new data that you provide to us.

Right to erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for our continuing to process such data. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. You also have the right to object where we are processing your personal data for direct marketing purposes. Right not to be subject to automated decision-making (including profiling) where that would have a significant effect on you. We do not in fact engage in such activities, so this right will not, in practice, be relevant in the context of your use of the Site.
